Art. 4 - User Obligations

1. The User undertakes to visit the website in good faith, collaborating with Blaster Foundry to allow it to be accessible to all users who wish to visit it and play the advergames available within it.

2. The User undertakes not to alter in any way the code of the website and the applications contained therein, through practices of decompilation, disassembly, reverse engineering, system violations or improper use of the product, making all reasonable efforts to maintain the functionality of the software.

Art. 5 – Website Use

1. The use of the website and the video games present within it is entirely left to the User and will not involve Blaster Foundry even in terms of control and supervision.

2. 1. Blaster Foundry S.r.l. undertakes to carry out maintenance of the website by making available to the User, during the period of validity of these Terms & Conditions of Use, any updated versions based on identified needs.

2. Ordinary Maintenance and Extraordinary Maintenance activities – potentially generating partial or total interruptions of the possibility of accessing the website – will not be communicated in advance to Users.

Art. 7 - Intellectual Property

1. Unless otherwise agreed between the Parties, the models, schemes, algorithms, graphic elements, trademarks, logos and any other title of intellectual or industrial property, are of exclusive ownership and property of Blaster Foundry S.r.l.

2. The stipulation of these Terms & Conditions of Use does not entail, nor can it entail, any assignment, license or tacit consent to their use, except where expressly indicated.

Art. 8 - Service Costs

1. The use of the website is free.

2. In the section called "Request your game" it is possible to request a dedicated commercial offer that will be formulated based on the needs indicated by the customer.

Art. 9 - Force Majeure

1. Blaster Foundry s.r.l. will not be responsible for events that are beyond its reasonable control such as, among others, fires, floods, singular adverse weather conditions, war, guerrilla warfare, measures imposed by civil or military authorities, strikes, lockouts, general network failures, government actions or any other event that is considered by law a Force Majeure event.

2. If Blaster Foundry is prevented, hindered or delayed in fulfilling the obligations assumed under these Terms & Conditions of Use due to Force Majeure events, the obligation concerned will be suspended for the duration of the Force Majeure event and neither party will be considered in default.

Art. 10 - Personal Data

1. Blaster Foundry S.r.l. undertakes to process the personal data acquired in the context and in execution of these Terms & Conditions of Use in accordance with EU Regulation no. 679 of 2016 (so-called GDPR).

2. The processing of the User's and Users' personal data will take place in accordance with what is described in the privacy policy available at www.blasterfoundry.com/privacypolicy

Art. 11 - Final Provisions

1. This document constitutes the entire agreement between the Parties and replaces and extinguishes all previous drafts, contracts, agreements and understandings, both written and oral, relating to its subject matter and the obligations of the contracting parties.

2. If one or more clauses are affected by nullity or rendered inapplicable by the effect of the law or by a decision that is imposed on the Parties, this will not have the effect of causing the nullity of the whole of these Terms & Conditions of Use, nor of altering the validity and binding nature of the whole of the other clauses.

3. These Terms & Conditions of Use and any dispute or claim arising from or relating to it, its subject matter or its formation is governed and interpreted in accordance with Italian law.
